As Frank Lowe remembers going to a funeral in Workington at a time which fits with Mary Elizabeth's death, the circumstantial evidence that this is the correct marriage is overwhelming]

ASSAULT AT DRONFIELD

Frederick Low was summoned for having assaulted Hannah Hague, at Dronfield, on 1st Feb.--

The complainant, a respectable-looking woman, said the defendant married her daughter. His conduct towards his wife had been very bad indeed, and on the 1st. inst. he assaulted her. Her daughter ran home to her for protection, and on complainant going to the defendant to tell him that he must not lay hands on her child, he committed a violent assault upon her. So violent was the assault that she was insensible for four hours.--

Two witnesses were called to speak to the assault, but there evidence was more in favour of the defendant than the complainant.--

The defendant called his father to prove that he was not the aggressor, and with the Magistrates' consent, his wife entered the witness-box but was not sworn. She said her husband had never ill-treated her, and on the day named, he did not strike her.--

The Bench said it was only natural to suppose that a wife would not speak against her husband. They however, thought that the assault complained of had been committed, but as the complainant did not desire to punish him, the case would be dismissed on the payment of the costs, and on his promise to behave better in future.
