Some records say the bride is Mary Spedding, but the entry in the Bishop's Transcript clearly says Anne. As census, second marriage and death records all say Mary, I think the Bishops Transcript is wrong.

accused of murder in 1821.

A report in Freeman's Journal and Daily Commercial Advertiser (Dublin) for Tuesday 6th March 1821 reads:

On Monday week [i.e. 26th February 1821] an Inquest was held before the Coroner of the Liberty of Furness, at Moor, in Torver, on the body of John Jones, dancing master. It appeared the deceased and William Massicks has a quarrel on Saturday night, between twelve and one o'clock, when deceased slapped Massicks on the face twice, and a fight ensued, when Massick's father interfered, but the deceased knocking the younger Massicks down, he begged of deceased to be quiet, and said he (Massicks) would submit, and immediately left the house. The elder Massicks and Jones then had a scuffle, during which the candle was knocked out, and they both fell on the floor; upon which the younger Massicks came very quickly into the house through a back passage and joined in the fray, and with a knife, or some such sharp instrument, inflicted sixteen different wounds upon the deceased. He died between two and three o'clock in the afternoon of Sunday, and the jury returned a verdict of - Wilful Murder against the younger Massicks, and against the elder for aiding and assisting in the murder. The latter was committed to Lancaster Castle by the Coroner, who issued a warrant for the apprehension of the former. The quarrel arose at cards.

A further report of the murder has been found in the Liverpool Mercury of Friday 13th April 1821. This entry has the first words of each line lost in the fold of the page. As far as can be seen, it reads:

Lancaster Assizes, Thursday 5th April 1821

... Massicks, Snr was charged with having (by the ... Massicks, jnr (not in custody), murdered ... by stabbing him with a knife, at Moor-in- ... . The prisoner, the deceased, and several others ... partaking of the hospitality of a neighbour, ... make a feast on the killing of a pig. They ... drinking and playing cards, and in order to ... to give up playing, one of the party con-... : a scuffle in consequence ensued between ... and Jones, and both fell. At that moment, ... Massicks came in and stabbed Jones in two or ... None of the company knew that he was ... a knife, and the proof, as to the individual ... stabs, rested on the dying declaration of ... . The unfortunate man died next day. ... (the elder Massicks) was, of course, found.....

ON the 16th Day of January in the Year of our Lord 1823 the annexed Will of John Massicks late of Torver Church House in the Parish of Ulverston in the County of Lancaster within the Archdeaconry of Richmond, in the diocese of Chester, who departed this life on or about the sixth day of August 1822 was proved in common Form, and Daniel Burkett of Scarr Head in Torver in the Parish and County aforesaid, Yeoman, one of the executors therein named was sworn well and faithfully to execute and perform the same and so forth (power being reserved for William Wilson of High Style in Torver aforesaid, Yeoman one other executor in the said Will named and so forth) and that according to the best of the Knowledge, Information and Belief of the said Daniel Burkett the whole of the Goods, Chattels and Credits of which the Testator John Massicks died possessed, within the Archdeaconry of Richmond, in the Diocese of Chester (exclusive of what the said Testator might have been possessed of or entitled to as a Trustee, for any other person or persons, and not beneficially, and without deducting any thing on Account of the Debts due and owing by and from the said Testator) were under the value of £100

This is the last Will and Testament of me, John Massicks of Torver Church House in the township of Torver in the Parish of Ulverston in the County of Lancaster, Yeoman

I give, devise and surrender unto Daniel Birkett of Scarr Head in Torver aforesaid and William Wilson of High Style in Torver aforesaid all and singular my Messuages, Tenements, Lands, Hereditaments and Premises situate, lying and being in Torver aforesaid (saving and except the Dwelling House wherein I now reside, with the Outhousing, Garden and Orchard with the Close of Land adjoining thereto known by the name of Kirk Close and the Doles in Torver Highbeck Meadows which are hereinafter by this my will disposed of) with their and every of their appurtenances to hold to them the said Daniel Birkett and William Wilson their heirs and assigns for ever according to the custom of the Manor of Torver


Upon special trust and confidence that they the said Daniel Birkett and William Wilson or the Survivor of them, his heirs or assigns do and shall immediately after my decease or as soon as to them shall seem convenient and proper sell and dispose of the same Hereditaments and Premises either by Public Sale or Private contract and give good and sufficient discharges for the purchase money without the Purchasers being answerable or accountable for the loss, misapplication or nonapplication of the same or any part thereof. The same hereditaments and Premises to be sold either altogether or in lots as to my said Trustees shall seem most advisable for the benefit of my Family


and out of the purchase money arising from the said Sales in the first place to pay off and discharge all mortgage monies due, owing and chargeable upon the said Hereditaments and Premises


and in the next place to pay and discharge all my just debts, funeral and testamentary expenses


and then to place the remaining part thereof out upon good security and with the interest to keep and own the Dower due to my mother and pay my Sister's annuity when, and as soon as, they shall respectively become due

and then to keep and own the interest of what may be chargeable upon my said House, Outbuilding, Garden, Orchard and Close of Land and Meadow Doles during my Wife's Life and pay and apply the remaining interest unto my Wife during her life


and from and after her decease to divide the said Surplus money amongst all and every my children, excepting my son Thomas, share and share alike, and in case any of them should then be dead leaving lawful issue such issue to take his, her or their deceased Parents share amongst them, share and share alike


I give and bequeath unto my said Wife for and during her natural life all my Household Goods and furniture, Husbandry Gear and Stock, and after her decease I direct the same to be sold and the money arising therefrom to be divided amongst all my children share and share alike


I give devise and Surrender unto my said wife for and during the term of her natural life the House in which I now reside with the Outhousing, Garden, Orchard, Close of Land called Kirk Close and the Doles in High Beck Meadows, she keeping the building in good and tenantable repair. She enjoying the same free from all mortgage interest and [indecipherable]


and after her decease I give devise and surrender the same unto my son Thomas, his heirs and assigns forever. He paying thereout within twelve calendar months after my said wife’s decease to my said Trustees the sum of one hundred and fifty pounds, to be by them distributed equally amongst all and every my other children and their issue as aforesaid


and I do declare that the bequest and devise hereintofore made to my wife is in full [indecipherable] and satisfaction of all her Dower or Copyhold right as my Widow


and I do declare that any said Trustees shall not be answerable or accountable for the actions or receipts of the other or other of them, but each of them for his own actions neglects on receipts only,


and that they shall be allowed a reasonable recompense for their and each of their loss of time, trouble and expense


and lastly I appointed them the said Daniel Birkett and William Wilson Executors of this my last Will and Testament


In Witness whereof, I the said Testator John Massicks have to this my last Will and Testament set my hand and Seal the sixth day of August in the year of our Lord one thousand eight hundred and twenty two.

[It may be that John lied about his father's name and occupation, and Maria lied about her father's occupation. Why would they give Kimberworth as their address? Is the fact that Maria is not of full age relevant? If so, why didn't she lie about that as well?]


The confusing discrepancies in the information on this certificate when compared with information from other sources caused problems for many years. It was finally established that Mary Jane, the daughter of John and Maria, was staying with her uncle William Johnson, on the 1861 census. William's marriage certificate was eventually traced after his wife's maiden name was obtained from the birth certificate of their son, Rotherham. William's marriage certificate shows that his father was called Richard. This is confirmed by earlier census entries. It is therefore clear that John Johnson's father was called Richard Johnson. This discovery has allowed the removal of the non-existant Thomas Johnson from the database, and the linking of John Johnson with his true family.

BRUTAL CASE OF WIFE BEATING

John Johnson, Eckington, was charged with committing a violent assault on his wife, Maria Johnson, on the 13th inst. From the complainant's evidence, it appeared that for some time before Easter, she and her husband had lived together very uncomfortably. They attempted to settle matters between themselves, but unsuccessfully, and a similar attempt with the assistance of Mr Alderson, also failed. As they were returning from Mr Alderson's office, however, the husband agreed to give her 10s. a week to keep herself and six children. She accordingly went to live with her brother at Sheffield, and remained there until Good Friday, when the defendant called on her and promisied that, if she would return and live with him, he would live peaceably with her. She went home the next day with her children, and finding her husband out, prepared his supper, and afterwards went to bed. He returned in a state of intoxication, dragged the complainant out of bed, and abused her violently. He continued to maltreat her as long as she stayed in the house, and on one occasion heated the poker, and threatened to run it into her, using at the same time very disgusting language.... In defence, the defendant said that the quarrels were caused by his wife admitting that she had been living in adultery with another man for 14 years. He put in a written confession to that effect, but the Bench refused to receive it, intimating that they believed - as was alleged by the complainant - it had been wrung from her by force.... Mr Bowdon said the defendant was a very great brute, and would be bound over to keep the peace for six months, in his own recognisances of £20 and two sureties of £10.


[The Alderson mentioned may well be Alfred Alderson, a solicitor living at Coldwell House - which is probably Coldwell Cottage at the end of Southgate - on the 1861 census]

A FATHER CHARGED WITH BEATING HIS CHILD

John Johnson, of Eckington was summoned by his wife for cruelly beating his daughter, Emma Johnson, a girl about 11 years of age.-- Mr Chambers appeared in defence. The little girl said that on Wednesday before last her father called her up about 6 o'clock in the morning, and beat her first with his hand and then with a strap, because she had not washed the tablecloth on the day previous. After the father chastised he went to his work, and the little girl returned to bed.

-- Cross-examined by Mr Chambers: Witness had been told by her father twice - once on the Monday and again on the Tuesday - to wash the cloth, and she had forgot to do so. She had also gone into the town after having been told by her father not to go. When the father chastised her he told her of these offences; he beat her very severely. After he beat her he sent her to Sheffield to take a message to her mother. The mother did not live with witness's father; there was an unpleasantness between them, and they had been parted for some weeks. When witness got to Sheffield the mother examined her back, and took her the same day to Hemsworth Courthouse and got out a warrant, and then sent witness home to Eckington. The mother said that witness was not to tell her father that she had been to Hemsworth to get a summons.-- Mrs Johnson, the mother, then stated that she examined her daughter's back. She found it covered with the marks of the strap, and the skin was broken in two places.-- Mr Alderson, the magistrates' clerk, proved that when the girl applied for the summons, he examined her back. He certainly thought that she had been chastised too severely.-- The magistrates thought that under the circumstances the punishment would be severe enough if they ordered the defendant to pay the costs.

Rotherham Esq, that the case had been brought before the Board of Guardians at Chesterfield, and that they had decided to forgive the defendant the cost due for his family's maintenance on condition that he at once took them off the parish, and on the strength of that he had come to Eckington. These arrangements, however, had not been notified to the overseers, so the warrant was taken out.... Mr Bowdon ordered the defendant to pay 10s. 6d costs, and suspended the warrant for the month, to give the defendant an opportunity of taking his family off the parish.

Defendant said he did not ill-use her, nor did he spit in her face.-- A witness said she saw the man push complainant down, and likewise spit in her face.-- The Bench said they did not know which party to believe; they must, therefore, pay the costs between themselves.

ECKINGTON.-- STRIKING A MAN WITH A POKER

Elizabeth Holmes, Eckington, was charged with unlawfully wounding John Johnson, by striking him with a poker on September 3rd.-- Complainant, an old man, said he was a carter and lived at Eckington. On the date named he was near to the defendant's house. He spoke to her and told her that her boy had been doing damage to his wall. She said "You're a liar. If you're not off I'll give you some poker." She came out of the house and struck him twice over the left arm, and a third blow which caught his cheek and felled him. He went home and had his cheek dressed by Dr Taylor.-- Complainant denied in answer to the defendant that he challenged her to fight.-- Dr Taylor, assistant to Dr G H West Jones, said he dressed the complainant's cheek and put two stitches in the wound. The wound must have been caused by a blow.-- Defendant said that complainant used bad language to her, and also challenged her to fight. She went out and complainant struck at her. She then hit him with the poker. He afterwards challenged her again and said "I've got something that will draw blood sooner than the poker".-- Rachel Wilkins, Eckington, corroborated.-- The defendant was fined £3, including costs, or a month.-- Defendant: I'll do the month.

A FATHER CHARGED WITH BEATING HIS CHILD

John Johnson, of Eckington was summoned by his wife for cruelly beating his daughter, Emma Johnson, a girl about 11 years of age.-- Mr Chambers appeared in defence. The little girl said that on Wednesday before last her father called her up about 6 o'clock in the morning, and beat her first with his hand and then with a strap, because she had not washed the tablecloth on the day previous. After the father chastised her he went to his work, and the little girl returned to bed.

-- Cross-examined by Mr Chambers: Witness had been told by her father twice - once on the Monday and again on the Tuesday - to wash the cloth, and she had forgot to do so. She had also gone into the town after having been told by her father not to go. When the father chastised her he told her of these offences; he beat her very severely. After he beat her he sent her to Sheffield to take a message to her mother. The mother did not live with witness's father; there was an unpleasantness between them, and they had been parted for some weeks. When witness got to Sheffield the mother examined her back, and took her the same day to Hemsworth Courthouse and got out a warrant, and then sent witness home to Eckington. The mother said that witness was not to tell her father that she had been to Hemsworth to get a summons.-- Mrs Johnson, the mother, then stated that she examined her daughter's back. She found it covered with the marks of the strap, and the skin was broken in two places.-- Mr Alderson, the magistrates' clerk, proved that when the girl applied for the summons, he examined her back. He certainly thought that she had been chastised too severely.-- The magistrates thought that under the circumstances the punishment would be severe enough if they ordered the defendant to pay the costs.
