Criminal | 24 January 1863 | She was involved in Court proceedings on 24 January 1863 in Whitwell, DerbyshireG, From the Derbyshire Courier: ECKINGTON POLICE Friday 16th Jan (Before H Bowdon Esq) Two men named Walter Tompkin and John Ellis, both of Whitwell, labourers, were charged with stealing a hen, the property of Sarah Wells of Whitbrick Moor, near Whitwell, on the 12th of January.-- Sarah Wells, widow, said she kept a quantity of fowls, which perch in some outbuildings. On Sunday, the 11th, she had thirteen fowls. In the night she was awoke about a quarter to one, and got up and followed her son, Henry Wells, out of the house, with a candle, to the places where the fowls sat, and in one of them found the prisoner Tompkins. They took him into the house for some time, and then let him go. On Monday, she went to feed the fowls, and found one of them missing.-- Henry Wells confirmed the mother's evidence.-- Inspector Cupit said: On Monday morning last, from information I received, I went to Mrs. Wells's, and examined the premises, and in the stable near a hole in the wall, I found some loose hen feathers; there were also some loose feathers in the hole. I found some footprints at the back of the buildings, all made by one party. I traced them across a field into a lane. I also saw similar footprints in a field coming towards the house; there were footprints there as of two persons. On the Sunday night, being on duty, I saw the two prisoners together about a mile from Mrs. Wells's, at half past eleven. They were going in the direction of Whitbrick Moor. I had seen them together previously at Barlbro'. I went and apprehended Tompkins, and on the way to the lock up he said voluntarily, "I will speak the truth; I was there, and John Ellis was with me; I killed the fowl, and put it through the hole to him." He said it was the cock they went for, but he must have killed the hen by mistake. I then, on Monday night, took Ellis into custody, and charged him with stealing the fowl along with Tompkin. On Tuesday I took Ellis's boots, and compared them with the footprints at the back of the house, and also those in the field, and they corresponded exactly. The left boot had three sprigs out of the inside of the sole.-- Prisoner Tompkins said: I am guilty, and I hope you will have mercy.-- Prisoner Ellis said: I said to Walter, "Where are you going, there?" and said, "Come, let us go home." Walter went along, and I went home and left him, and no one can say I was about the place after I left him there at Mrs. Wells's.-- Both prisoners were committed for trial at the next Derby Assizes. |
